What to ask contractors for: North Carolina workers' comp
3 min read · Last updated
North Carolina's workers' compensation rule turns on how many employees a business has on a regular basis, and the official page counts corporate officers toward that number. This guide sets out what the state's official page says and which documents to request from contractors. General information, not legal or insurance advice; check your contracts and your insurer. Facts last checked on 7 November 2026 against official state pages.
What the official sources say
The North Carolina Industrial Commission's workers' compensation insurance requirements page (https://www.ic.nc.gov/wcinsrqmt.html) states that, in general, 'all businesses employing three or more employees on a regular basis are covered by the Act.' The page cites Chapter 97 of the NC General Statutes.
The same page says that 'Corporate officers are counted in determining whether the corporation has three or more employees.' For a corporation, its officers therefore count toward the three-employee figure.
What this means for collecting vendor documents
For a contractor with three or more employees on a regular basis, the page describes workers' compensation coverage as the general rule. Ask for a certificate of insurance that shows workers' compensation coverage and its policy period, and keep the expiry date on file.
For a contractor that says it has fewer than three employees, ask for a signed and dated statement of its headcount. Ask the statement to show how corporate officers were counted, because the page counts them. A statement is a record of what the vendor reported. It is not a legal opinion on whether coverage is required, and this guide does not decide that for any vendor.
Record each certificate's expiry date and set a reminder before it passes. A certificate shows what was reported on the date printed, and a renewed policy usually comes with a new certificate.
How ShowMeTheDocs helps
ShowMeTheDocs keeps each vendor's certificates with their expiry dates and status. Starter requirement packs list the trades each requirement applies to, so a workers' compensation requirement can be set for the vendors it applies to. Vendors are emailed 30, 14 and 7 days before an expiry date, and they upload certificates through a self-service portal link without needing an account.

Questions
Does a certificate of insurance prove a contractor has workers' compensation coverage?
It shows what the insurer or agent reported on the date printed. It does not change the policy, so check the policy period and expiry date, and check the policy itself where a contract depends on a specific term.
Do corporate officers count toward the three-employee figure?
The official page quoted in this guide says they are counted in determining whether a corporation has three or more employees. Confirm how the rule applies to your own vendors with your attorney or insurer.
Does this guide cover every North Carolina rule?
No. It covers only the employee-count sentences quoted from the official page. Exemptions, other rules and general contractor licensing are outside its scope.
